  1. Definitions
    1. "Us", "We", "Our", "Company",  "Monbell" = our business and refers to Monbell
    2. "Customer", “You” = the individual who places an order
    3. "Website"= monbell.com.au
    4. “Agreement “= the contract to purchase goods formed when you order items using this website
    5. "Products"= the items listed on the website for sale
    6. "Business Day"= a day of the week that is not a Saturday, a Sunday, a Bank Holiday or Public Holiday in Australia.
       
  2. Agreement to Terms and Conditions
    1. In any event these Terms and Conditions govern your access to the website and the supply and purchase of any Product by you.
    2. We reserve the right to amend these Terms and Conditions at any time without necessarily giving notice to you in addition to posting the changes on the website. Changes are effective at the time of posting and continued use of this website will constitute acceptance of the Terms and Conditions as amended from time to time.
       
  3. Website Use
    1. You take full responsibility when you access the website and must ensure that accessing the website is not illegal under any laws applicable to you
    2. Links on the website are published for your convenience and we are not responsible for keeping them up to date or for the content or policies of any other website.
    3. We do not have any responsibility for any loss whatsoever (including, without limitation, indirect, incidental, special, or consequential loss, loss of profits or loss of opportunity), expense, damage or injury incurred by using or being unable to use the website. You must take your own precautions to protect against viruses, malicious computer codes or other issues that may cause damage to your computer or software.
       
  4. Product Specifications
    1. We make every effort to ensure that all our products are accurately described as to features, patterns and colours, measures and weights. However, you acknowledge that:
    2. The features and specifications of our products are subject to change without notice
    3. All weights and measures are approximate
    4. All attempts are made to display the true likeness of products, but because many of our products are handmade there may be a difference in colour from our website to your screen.  Colours on your screen may also vary because of the highly variance in colours utilised by computer monitors. Monbell will not incur any liability for any colour variations between the actual product and the images shown on the website.
       
  5. Pricing
    1. At Monbell we do our best to guarantee that published prices are up to date and accurate.
    2. All the prices on the website are in Australian dollars and are inclusive of taxes unless otherwise stated.
    3. All the prices on the website are subject to change without notice. If a price is changed after your order has been placed and before delivery we will contact you to seek permission to proceed.
       
  6. Orders and cancellation of orders
    1. Orders are placed online through the website.
    2. You should make your choice of Products carefully. We do not accept a cancellation of an Order because you change your mind about the purchase. You should carefully assess all aspects of the Products you select when you put them in your Shopping Cart.
    3. When you submit an Order you agree to these Terms and Conditions.
    4. We are not obliged to supply any product until we have accepted the Order. We will accept the Order by sending you a Confirmation of the Order by email to the address you provide when placing the Order.
    5. Monbell is mainly an online business and we communicate with all customers primarily through an email address the customer has provided. It is responsibility of the customer to ensure the contacts provided are correct at all times and emails are checked and accessed regularly.
    6. Monbell reserves the right to decline or cancel any order at its discretion for any reason.
    7. You may cancel any Order up to the time your payment is processed without cost to you.
    8. In the event an Order is cancelled by us then the amount paid will be refunded using the same Payment method as was used when the Order was processed, at the earliest practicable time. We will communicate with you by email with regard to any cancellation and refund.
    9. We do not accept any responsibility for Orders that are delayed, declined or cancelled due to internet connection disruptions.
       
  7. Payments
    1. We accept payments by Credit Card issued by VISA and MASTERCARD.
    2. It is your responsibility to ensure that all Payment details are correct
       
  8. Delivery
    1. Charges for delivery are in addition to the advertised cost of the Product and will be notified to you and charged at the time the Order is processed. You agree to pay delivery charges as shown when you place and pay for your Order.
    2. We use the services of independent Logistics companies to deliver the Products.
    3.  We understand how important is for you to receive the products ordered as soon as possible. For that reason we aim to have Stock Items delivered within 15-21 business days from receiving your Payment.
    4. For those products that are not in stock or that must be made to order you should contact us to confirm the estimated date of delivery before placing your Order
    5.  The dispatch or delivery time provided for particular goods is an estimate only and is subject to change without notice. Delivery time depends on certain factors such as specific location, freight, delivery or courier carrier. An email will be sent to you with estimated delivery time and freight.
    6. Upon delivery, you will be asked to sign a delivery note, and in doing so you confirm that the Product was delivered with no apparent damage and/or defects. You should refuse to accept any delivery if there is any visible damage to the packaging.
    7. The title to the Products and risk pass to you when you sign the delivery note.
    8. We will not dispatch Products to Post Office Box addresses.
    9. You acknowledge that delays in delivery do occur and that we not are not liable for any loss and/or damage caused by delivery delays which are beyond our control. Delay in delivery beyond our control does not give you any right to cancel the order or claim the purchased price or delivery cost.
    10. If you specifically request an unattended delivery or delivery without signature, any insurance cover will be voided when the item is delivered as instructed and the title to the Products and risk pass to you at that time.
    11. Delivery is made by a single delivery driver to the ground floor of the premises or a front door at street level. The driver will not carry items inside, upstairs or into elevators or unpack, place or assemble the Products or remove any wrapping or the like. You must arrange for other persons to help you to bring the Products inside your residence and unpack them. We suggest that you ask the help of neighbours, family or friends.
    12. If products weigh over 25 kg you are required to provide assistance to the driver to unload the package from the vehicle to the front door/ground floor of your premises.
       
  9. Damaged or Faulty Items
    1. We recommend that you unpack and inspect the products at the earliest possible time after delivery, to confirm that you are completely satisfied with the Products and that they are of acceptable quality, and match the description we have provided to you. You must notify us within 24 hours of the delivery if a Product is damaged or faulty. You must send an email to support@monbell.com.au

  10. Warranties
    1. All goods are supplied with a 12 month standard warranty against major failure in production or materials. The warranty is valid for Australian residents only and does not exclude the statutory warranties provided by the Australian Consumer Law.
    2. The warranty does not cover normal or fair wear and tear, damage arising from abnormal use or abuse, placement in inappropriate locations, goods that have not been maintained or that have been modified
    3.  We will repair, provide spare parts or replacement parts or replace entirely any part or product that is covered by this warranty.
    4. You must comply with the directions given by our staff in order to facilitate the investigation of the warranty claim and the provision of a solution. The directions will usually include the provision by you of a detailed description of the warranty claim and photos and videos (where appropriate)
    5. You should only return products to us if we give you directions to do so. You must bear the cost of returning the products and we will reimburse you for that cost if we are in breach of our warranty.
    6. We are not obliged to provide warranty services if the customer does not comply with the directions provided by our staff with a view to investigating and providing an appropriate solution.
    7. Our Products come with warranties that cannot be excluded under the Australian Consumer Law.
    8. Minimal variations in advertised dimensions or colour, grain or finish between the product displayed on the website and the product received by the customer, or damage to the packaging only are not covered by this warranty
    9. Our Lighting Products are wired according to Australian Standards and may not comply with the Standards applicable in other countries. We accept no responsibility for any compliance issues or problems that may occur when our Lighting Products are to be delivered to, or taken outside of, Australia and installed in another country.
       
  11. General
    1. No failure or delay by us or you in exercising any right under these Terms and Conditions or under a Contract shall necessarily operate as a waiver of such right or extend to or affect any other or subsequent event or impair any rights or remedies in respect of it or in any way modify or diminish rights under these Terms and Conditions or a Contract.
    2. If any of these Terms and Conditions becomes or is declared to be unenforceable or invalid, that should not affect any other clause of the terms and conditions
    3. These Terms and Conditions shall be governed by, and construed in accordance with the law of Western Australia.
       
  12. Intellectual Property
    1. Unless otherwise stated, intellectual property in all the Products and materials used on the website belongs to us. Unless expressly authorised, you shall not copy, adapt, modify, display, perform or distribute any Product or material or any part thereof or permit any other person to do so.
       
  13. Privacy
    1. We collect personal information about our customers for marketing, supplying or delivering our products to you, carrying out repair work, improving and developing our products and expanding our business.
    2. We do not share, rent, sell or trade your personal information. We are committed to protecting your privacy and personally identifiable information. We are legally and ethically committed to comply with the law and we understand how important this is for you.
    3. We may gather information about our customers, that type of information includes information about people who access our website or engage in a business relationship with us. We gather the information from these people directly and from information obtained from public domain sources such as newspapers and magazines
    4. Under the Privacy act 1988 you are entitled to request and access your personal information held by us. You can do this by emailing us at support@monbell.com.au and we will assist you.
